Citation 1.This regulation may be cited as the Fire and Rescue Force (Safety Inspections
and Certificates) Amendment Regulations, 2012 and shall be read as one with
The Fire and Rescue Force (Safety Inspections and Certificate) Regulations, 2008.
Amendment 2. Regulation 2 of the Principal Regulation is amended by inserting appropriate
0f regulation 2 alphabetic order the following definitions-
“Bar” means premises;
Cap 77 a) For which a general license has been issued under the Intoxicating Liquor Act and
b) That does not have facilities for providing accommodation.
“Category” means a category of property use mentioned in first and second schedule
“Club” means premises for a body or association of persons established for
community service, culture, literary, recreational, social or sporting purpose, or a
similar lawful purpose.
“Construction site” means premises on which, when construction is complete, will
be a building to which a category (other than construction site) in fire levy groups 3
to 16 applies.
“College residential quarters” means a residential facility for students of a
college education institution, but does not include a single unit residence used for
accommodation by students.
“Drive –in shopping centre area:, means a prescribes property that includes —–
a) 2 or more shops, whether or not in the same building; and
b) Car parking for customers.
“Fuel Service Station” means a facility which sells fuel and usually lubricants for motor
vehicle.
“Godown”: A place adapted to the reception and storage of goods and merchandise.
“Gross floor area”, of a prescribed property, a part of a prescribed property, or a level of a
building on a prescribed property, means the total of the floor areas (including all walls,
columns and balconies), having a ceiling or roof, of the property, the part of the property, or
the level.
“Inspection fee” means the fee, charges and other non-tax revenue arising from the
inspection of various properties and premises in their area of jurisdiction.
“Landscaping” means an area of land treated, to enhance or protect the amenities of the
land or its locality, by:
a) screening with fences, walls or in another way: or
b) planting trees, hedges, shrubs or grass: or
c) forming banks, terraces or other earthworks: or
d) laying out gardens or courts; or
e) constructing walkways or tracks.
“Licensed premises”, in relation to a club or restaurant, means premises for which a
license is in force, under the Intoxicating Liquor Act to sell liquor.
“Level”, of a building, includes a basement or mezzanine level of the building.
“Outbuilding” means a non-habitable building, for example, a carport, garage or shed.
“Outdoor storage area”, includes the following;
a) an area used as a builder’s, or contractor’s, yard;
b) an area used for storing garden materials;
c) a fenced area for packing or storing heavy equipment, materials, motor vehicles or
boats, other than for retail sale.
“Premises” means the building and land near to it that a business owns or uses.
“Property” means a buildings and the surrounding land.
“Resort complex” means premises that include;
a) Accommodation, most of which is used for holiday or tourist purposes; and
b) Recreational or amusement facilities; and
c) Restaurants; and
d) Shops or commercial premises; and
e) Car packing facilities.
“Shop” means establishment or premises where the sole or principal business carried out is
retail, or where people can deliver goods for repair or other treatment.
“Single unit residence” means prescribed property, consisting of self contained
accommodation for the exclusive use of persons residing on the property and any other
incidental building.
“Substation” means a subsidiary station for a service, including, for example, a service for
supplying electricity, gas or water, a telecommunications service, or a service for removing
sewage.
“Tanzania Revenue Authority” means the authority established by the Tanzania
Authority Act.
3. The regulation is amended:

(i) By adding immediately after sub regulation 3(2) that would be sub
regulation (3)
The Certificate issued sub-regulation 3 (2) shall be valid for a period of one
year from the date of issue, there after the property owner shall apply for it
to be renewed.
(ii) By adding immediately after sub regulation 3(3) that would be sub regulation (4)
Any owner of the property, premises, vehicle, vessel who fails t renew his Fire
Safety Certificate within one month after its expiry will be required to pay the
principal amount payable in respect of that property plus penalty of twenty five
per centum (25%) for late payment.
(iii) By adding immediately after sub regulation 3(4) that would be sub regulation
(5)
The fee payable for vehicle shall be paid to the Commissioner General of Tanzania
Revenue Authority on behalf of Commissioner General of Fire and Rescue Force,
and all payment shall be done through Authorized banks.
4. The Principal Regulation is amended by substuting the Second Schedule with First
Substuting and Schedule of the amended regulation and adding the Third Schedule immediately
